These Terms of Service ("Terms") govern your access to and use of the website, services, and digital platform operated by Producer K ("Company," "we," "our," or "us").
By accessing our website or purchasing any of our services, you agree to be bound by these Terms. If you do not agree, you should not use our website or services.
1. Our Services
We offer song production packages (Start, Entry, Complete Artist and Premium) and optional add-ons. Depending on the package, our services include:
- Custom song production and arrangement
- Vocal direction and live Zoom sessions with your producer
- Guided recording sessions
- Vocal editing, mixing and mastering
- Album artwork
- Worldwide digital release
- Creative progress reports
We also offer the Free Direction Check, a free pre-purchase survey after which we email you a direction report with a recommended package. It is not a purchase and does not create an order.
What each package includes is shown on its package page. All services are provided subject to availability and acceptance of your order.
2. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to purchase services from us.
By using our website, you represent that you have the legal authority to enter into this agreement.
3. Pricing & Payments
Prices are shown in US dollars and may change without notice. The price you pay is the total shown at checkout, including any add-ons you choose.
You pay the full amount when you place your order. Checkout is handled by Shopify, and payments are processed by our payment providers (such as PayPal).
Your project is confirmed once your payment has been completed.
4. Project Timeline
Most projects are completed within 4 weeks. Estimated completion dates are provided for planning purposes only.
Actual delivery times may vary depending on:
- project complexity
- client response time
- revision requests
- technical issues
- scheduling availability
We are not responsible for delays caused by incomplete information or delayed communication from the client.
5. Client Responsibilities
You agree to:
- provide accurate project information;
- submit requested materials in a timely manner;
- attend your scheduled Zoom sessions, or let us know at least 24 hours in advance if you need to reschedule;
- if you record at home, use a computer, an audio interface, headphones and a condenser microphone (recording on a phone isn't supported);
- ensure that you own or have permission to use any music, vocals, lyrics, samples, artwork, or other content you provide;
- review deliverables promptly;
- communicate revision requests clearly.
Failure to provide necessary materials may delay your project.
6. Revisions
Changes to the song itself, such as moving the key or adjusting notes that sit too high or too low, are agreed together before you record (in your vocal direction session, or at the start of your recording session with Start and Entry). Any further changes are discussed with your producer. Some requests may not be possible, or may incur additional fees, depending on the type of change.
Substantial changes outside the scope of your package may incur additional fees.
7. Intellectual Property
Until payment has been received in full, all project files, recordings, beats, stems, instrumentals, mixes, masters, artwork, compositions, and other creative materials remain the property of Producer K.
The composition. The copyright in the musical work (music, lyrics, and arrangement) belongs to the producers who write it. If you contribute to the lyrics or the story behind them, you are credited as a lyricist and share equally in the songwriter royalties with the other credited writers. If you are credited as a lyricist, we first check whether you work with a music publisher, since that affects how your share is registered.
The master recording. Unless you purchase the Master Ownership Transfer add-on, Producer K owns the master recording we produce for you. Your song is released under your artist name, and revenue from the master recording belongs to Producer K and is not shared. Income from your own activities, such as live performances and broadcasts, is yours.
Master Ownership Transfer. This add-on is available with the Complete Artist and Premium packages. Upon full payment, Producer K transfers 100% ownership of the master recording to you by a written assignment that we email to you after your order. We connect you directly with a distributor so that your release and the master revenue are held in your own account; if your song has already been released through our distribution account, we move it to yours. Licensing the recording for film, TV, advertising, or games also requires permission from the owners of the composition; when you approve a license for your master, Producer K’s songwriters approve it as well. After the transfer, both parties may continue to use the recording and related content in marketing, as set out in the assignment.
Credits. Releases credit Producer K together with the producer’s name, for example “Produced by Producer K ([producer name])”.
Files. You receive the final mixed and mastered audio files. Stems are included in the Premium Package and are available as the Stem Files add-on with the Complete Artist Package.
Registration. You register your own copyright and performer’s rights in your country, and we provide the materials you need to register. Copyright and performers’ rights apply according to the laws of each country.
Except as set out in this section or expressly agreed in writing, nothing in these Terms transfers copyrights, publishing rights, trademarks, or other intellectual property.
8. Client Content
You represent and warrant that any content you submit—including vocals, lyrics, recordings, artwork, samples, or other materials—does not infringe the rights of any third party. You agree to indemnify and hold us harmless against any claims arising from materials you provide.
9. Portfolio Rights
Unless otherwise agreed in writing, we may display completed projects, excerpts, artwork, audio samples, artist names, or other completed work in our portfolio, website, social media, or marketing materials.
If confidentiality has been agreed upon in writing, we will honor those obligations.
10. Cancellations & Refunds
Refunds are governed by our separate Refund Policy.
Work on your project begins when our producers start your first report after your payment. Once that work has begun, payments are non-refundable.
11. Third-Party Services
Our website may integrate with or link to third-party platforms including payment processors, cloud storage providers, streaming services, and social media platforms.
We are not responsible for the content, policies, or availability of third-party services.
